Policy


The term restitution means any property, lump sum, or periodic payment ordered to be made to a victim.  Restitution may be repaid with money or in the form of services performed by a child.  It is the policy of the State of Georgia to recognize that restitution is consistent with the goal of rehabilitation of juveniles.


Juvenile Courts are required to order restitution in the same manner as cases involving adult offenders.  In order to enforce the restitution order, Juvenile Courts are authorized and may retain jurisdiction over a juvenile subject to a restitution order until the juvenile reaches twenty-one years of age and the juvenile’s probation order may be extended to accomplish that purpose.  If the restitution remains unpaid once the juvenile reaches twenty-one, the Juvenile Court shall transfer the matter to Superior Court.

 

Under certain circumstances, where the restitution remains unpaid, the juvenile’s restitution may be transferred to Superior Court at the time the juvenile reaches eighteen years of age.

 

Victims may also have the right to pursue civil action, with certain limitations, against a child’s parents until the time the juvenile reaches eighteen years of age.
